North Face Apparel Corp. was awarded $7 million in damages in a lawsuit against Michael Chu, TGI Industries Inc., T. Glenn International Corp., Shanghai Apparel Group Inc. and Bestvalue International Inc. The lawsuit said that the above individuals sold garments and goods with the North Face trademarks as part of a multilateral counterfeiting ring. The defendants said they were simply producing clothing “inspired by” North Face Apparel Corp. I guess trademarks do work in the case of North Face being counterfeited, but all cases don’t turn out like this. Most don’t persue counterfeiters, but try and take it into their on hands and end up with another lawsuit. Take time to get your paperwork straight, everything from business licenses, copyrights, to 3rd party contracts. I think this news will have a lot of bootleggers, counterfeiters, and fleamarket hustlers thinking twice about stealing trademarks and logos of popular brands, unless their staying under the radar and in that case would it really be worth it?
