According to Apparel News that the Design Piracy law was introduced to the U.S. Senate on August 20, which obviously is a typo because it is only the 14th? We will figure out the exact date later.
Design Piracy law will grant designers the ability to copyright original garments where it is now limited to textile prints and surface designs. As of now many veterans and top executives are mixed on their feelings toward the subject and so am I!
I mean on one end it would give you more protection from other designers and clothing companies… I agree. Also a statement made by the executive director at the California Fashion Association llse Metchek makes sense to me. He and others against the law say that the law would stifle creativity and halt the flow of trends from the top echelon of design down to the mass market.
The protection for original garments is only for a period of three years and after that business would continue as usual. Expert say that will give a designer time to introduce the new garment and establish itself as a market innovator before competitors flood the market with knock-offs and cheaper copies.
I think with the time period that the law provides it is a sensible decision that would help protect creative original designers from bootleggers and letting them capitalize off of others unique garments.
